New Jersey Criminal Assault Charges Dismissed
Client charged with NJSA 2C:12-1 Simple Assault.
My client was charged with simple assault arising out of an incident in Met Life Stadium with a security guard. After several months of negotiations with the Prosecutor and extensive discovery battles including serving subpoenas on a State witness the Mr. Spector convinced the prosecutor to dismiss all charges because the allegations of assault were baseless and untrue.
New Jersey DWI And DWI With Minor Passenger Dismissed
My client was charged with DWI/DUI and a DWI with a minor passenger arising out of a motor vehicle accident. No one was hurt in the accident but my client was taken to the hospital for a blood test. The State did furnish a New Jersey State Laboratory Analysis Report result for the blood which was taken from my client after the accident. I was able to convince the prosecutor that the substance that was found in my client’s blood was not a banned substance. It was not a controlled substance or a scheduled substance. The substance was neither a narcotic or hallucinogen. As a result of the discussions with the prosecutor, the State dismissed the DWI/DUI and a DWI with a minor passenger.
New Jersey DWI Dismissed
My client was charged in Newark, New Jersey with a DWI and reckless driving for having a head-on collision with another motor vehicle. After receiving all the police reports which indicated that my client’s blood alcohol level (BAC) was a .14% I convinced the prosecutor that the BAC reading could not be used against my client because the readings were out of tolerance. Further, I argued that the field sobriety tests were insufficient to prove a DWI beyond a reasonable doubt. As a result, my client’s case resulted in a plea to reckless driving and a fine, without any drivers license suspension.
New Jersey Marijuana Case Dismissed
This week one of our client’s was relieved to hear that all their charges in Municipal Court were dismissed. Our client was charged with possession of under 50 grams of marijuana N.J.S.A. 2C:35-10 A(4) {Possession of Controlled Dangerous Substance [CDS] and N.J.S.A. 2C:33-2.1b loitering to obtain or distribute CDS.
After our law firm filed several motions and argued that the State’s failure to provide for discovery warranted a dismissal that is in fact what the court did, DISMISSED ALL CHARGES against our client.
