New Jersey Criminal Defense Attorney Discusses Plea Bargaining
As an experienced New Jersey Criminal Defense Attorney I am often asked about plea bargaining. There is plea bargaining that’s permitted in the New Jersey municipal courts. Even in the superior courts on more serious, what we call indictable or felony charges an individual would still be able to plea bargain.
However, certain charges are not subject to pleas. Technically, a DUI charge should not be plea bargained by a prosecutor. Technically, any drug charge that is before the municipal court, or marijuana which is considered a controlled, dangerous substance, is not subject to a plea or allowed to be plea bargained. That is why getting an experienced attorney on those particular matters is much more critical than some of the easier, maybe two point tickets that someone might do themselves.
