As an experienced New Jersey Criminal Defense Attorney, I am often asked by clients if marijuana is legal in New Jersey. New Jersey has only passed a medical marijuana law and people are eligible, if they fit in a certain criteria. They must go to their doctor and have themselves checked out to see if medical marijuana would benefit that patient, then that individual can then go to a dispensary to fill that certification (prescription).
It is still illegal to smoke marijuana in public, it is illegal to smoke marijuana and drive a motor vehicle, and it is still illegal to possess marijuana. You have to be very careful that if you do have a medical marijuana certification that your possession of marijuana is in the terms of your license to carry.
