Very often that’s not the case. Very often there’s some intent involved. In order for you to be successfully prosecuted, the judge would have to be convinced that you had an intent to deprive the store owner here of that property. If you went through the line and failed to pay for one item unintentionally, it would be very difficult for a prosecutor to prove that you had the intent to deprive the owner of that particular item.
