New Jersey DUI Attorney Explains Speedy Trial Rules
As an experienced New Jersey DUI Attorney, I am often asked by clients about speedy trials. In the state of New Jersey if you’re charged with a DWI or DUI, there is a speedy trial rule, although it’s not a hard and fast rule that pertains to the exact amount of time. A judge can consider the length of the delay; the reason for the delay; the prejudice that on the defendant because of the delay, and whether or not you and I have asserted our right to a trial. However, there is no hard, bright-line rule that says in six months your case must be dismissed.
I’ve had cases that last a very long time, and I have made motions for a speedy trial and they have been granted. I’m not saying that your case will be, but it is something to consider.
