New Jersey DUI Lawyer Discusses a School Zone DWI
As an experienced New Jersey DUI Lawyer, clients often ask me about getting a DWI in a school zone. In New Jersey if you’re charged with a DWI or DUI, you may also be given a summons for operating in a school zone. This is a statute that was borrowed from the drug statutes where people were charged with possessing or selling drugs in the school zone. They took that statute and brought it into the DWI charges.
What I do in every case where a client is charged with a school zone is I ask for the municipalities’ map which depicts the school zones in that location that the prosecutor would have to establish that you drove through if they want to prove a DWI in a school zone. What’s critical to understand is that a school zone conviction will double your penalties.
