New Jersey DUI Lawyer Discusses DWI Under 21

In New Jersey, a DWI or DUI for someone who is under the age of 21 is very, very different than an adult. This is because the blood alcohol threshold is considered a zero threshold, so anyone under 21 who blows a 0.01 up to a 0.07 is a DWI.
If you are underage and you have a DUI in the state of New Jersey, a 0.08 triggers you to be treated as an adult DWI. The penalties for an underage DWI for someone who blows a 0.01 up to a 0.07 are actually less severe than someone who blows a 0.08 or higher and is either underage or not. The penalties are not as severe for an underage DWI as long as your blood alcohol content is a 0.01 up to a 0.07.
