The first is the type of case where the person actually works for the store, so it really starts out as not a shoplifting at all, but a theft crime. Sometimes this can happen where they start out with having merchandise in their possession and then they try to get out of the store.
We were able to negotiate to where the person was prosecuted in the superior court and we were able to get what’s called pretrial intervention, where the person didn’t wind up with a criminal record, at all. That’s a similar, but somewhat different theft crime, but it involves being in a store and attempting to steal merchandise.
The other case is kind of a funny anecdote where I was a prosecutor and someone had gone into a local drugstore, and they left their iPhone in the store and then walked out. It was complex case because some other shopper came into that store, put it in their pocket, and walked out. We were able to view the store video just as in a shoplifting case. The person who essentially stole the iPhone brought it back the same day and put it in a different part of the store, so the police were able to identify who that first person was.
