Experienced New Jersey Shoplifting Lawyer Discusses Recent Shoplifting Cases
As an experienced New Jersey shoplifting lawyer, I have handled hundreds of shoplifting cases throughout my 30 years of experience as a criminal defense attorney. Let me give you an example of two cases. The first is the type of case where the person actually works for the store, so it really starts out as not a shoplifting at all, but a theft crime. Sometimes these theft crimes start by an employee having merchandise in their possession, and then walking out of the store with it.
In one of our recent shoplifting cases, we were able to negotiate a deal where the accused person was prosecuted in the superior court and we were able to get what’s called pretrial intervention. A pretrial intervention means that my client didn’t wind up with a criminal record, at all. That’s a similar, but somewhat different theft crime, but it involves being in a store and attempting to steal merchandise.
The other recent shoplifting case I successfully defended is a rather funny anecdote where I was a prosecutor and someone had gone into a local drugstore, and they left their iPhone in the store and then walked out. It was complex case because some other shopper came into that store, put it in their pocket, and walked out. We were able to view the store video just as in a shoplifting case. Using this surveillance footage, we were able to see that the person who essentially stole the iPhone brought it back the same day and put it in a different part of the store, so the police were able to identify who that first person was.
